Tyler Reece Livingston, a 25-year-old swim instructor from Emeryville, California, pleaded not guilty in Alameda County Superior Court (The People of the State of California vs. Tyler Reece Livingston, Case No. 24-CR-007305) to multiple felony charges stemming from allegations that he sexually assaulted young boys during swimming lessons. Livingston was arraigned in Oakland and is currently facing nine felony counts, including multiple sex crimes involving children, as well as firearm and drug-related offenses. Bail was denied pending a further hearing scheduled later this week.
According to prosecutors, the charges arose after two children, ages six and nine, reported being sexually abused by Livingston during swim instruction. A subsequent law enforcement investigation identified three additional child victims. Authorities allege that the abuse occurred in the context of Livingston’s role as a swim teacher entrusted with the care of minors.
During a search of Livingston’s residence, police reportedly recovered an unregistered firearm, high-capacity magazines, ammunition, suspected cocaine, and children’s clothing. The presence of these items led to additional criminal charges beyond the alleged sexual assaults.
Livingston’s defense attorney, Valery Nechay, requested that bail be set, arguing that Livingston has strong community ties and no prior criminal record. Prosecutors opposed release, citing the seriousness of the allegations, the number of alleged victims, and the ongoing nature of the investigation. Alameda County Superior Court Judge Elena Condes denied bail at the arraignment but scheduled a hearing four days later to reconsider the issue.
Law enforcement agencies continue to investigate Tyler Reece Livingston and believe there may be additional victims. Authorities are urging anyone with information related to Livingston or potential abuse to contact the Berkeley Police Department Youth Services Unit at 510-981-5715 or the Emeryville Police Department Investigations Unit at 510-596-3733.
