Were You Sexually Assaulted at Miracle Springs Resort & Spa?

Miracle Springs Resort & Spa in Desert Hot Springs, California promotes itself as a place for relaxation and healing. For some guests, it was the exact opposite – a setting where trust was exploited in a private room and the guests leaving shocked, violated, and unsure what to do next.

Attorneys at TLO Law, P.C. filed their first lawsuit in Riverside County Superior Court against Miracle Springs Resort & Spa in 2022 (Jane Doe vs. DHSO, Inc., et al., Case No. CVPS2200171). The complaint alleged that in September of 2021, Jane Doe visited the resort for a girls’ weekend and booked a massage at the spa. During that massage, Jane Doe was sexually assaulted by the spa’s massage therapist, Francisco Terredanio III, who rubbed and groped her vagina and breasts and nipples. Jane Doe immediately reported her sexual assault to staff at Miracle Springs Resort & Spa and later reported it to law enforcement. Discovery revealed that Miracle Springs Resort & Spa received several prior complaints of sexual assault involving the same massage therapist but did not take appropriate action. As a result of the assault, Jane Doe suffered emotional and psychological harm, pain and suffering, mental anguish, loss enjoyment of life, shame, and embarrassment.

The case was tried by Bobby Thompson of TLO Law, P.C. in Riverside County Superior Court in September 2025.

Miracle Springs Resort & Spa argued that it should not be held liable for the assault because they alleged Francisco Terredanio III was an independent contractor. The defense also argued that Jane Doe was lying, consented to the touching, and should have done something to stop the assault.

The jury returned a $4,268,650.17 verdict in favor of Jane Doe after evidence showed she was sexually assaulted during her massage at Miracle Springs Resort & Spa. The jury found the resort negligent and liable for sexual battery and sexual violence, rejected the defense’s independent contractor argument, and placed 90% fault on the resort. The verdict sends a clear message: resorts and spas can be held accountable when they fail to protect guests from foreseeable sexual misconduct.

TLO Law, P.C. has also filed a second civil case in Riverside County Superior Court against Miracle Springs Resort & Spa on behalf of two plaintiffs arising from similar reports by other victims (Jane Doe (C.S.), et al. vs. DHSO, Inc. dba Miracle Springs Resort & Spa, et al., Case No. CVPS2400961). In that case, survivors reported being sexually assaulted at the resort’s spa and by the same massage therapist, Francisco Terredanio III. Each survivor’s story is unique, but the underlying concern is the same – whether preventable safety failures, ignored warning signs, or inadequate oversight allowed inappropriate conduct to happen in the first place.
