Attorney Kristen Vierhaus of TLO Law, P.C. has filed a civil lawsuit in Sacramento County Superior Court on behalf of two Jane Doe plaintiffs who allege they were sexually abused while enrolled in childcare programs operated by KinderCare Learning Centers (Jane Doe, et al. v. KinderCare Learning Centers, LLC, et al., Case No. 25CV006771). The lawsuit concerns abuse alleged to have occurred at KinderCare at Natoma Station in Folsom, California, and Rancho Cordova KinderCare in Rancho Cordova, California.
According to the complaint, the plaintiffs – who are sisters – attended KinderCare’s school-aged childcare programs at two locations in Sacramento County. The lawsuit alleges that, between approximately 2015 and 2017, a male staff member or volunteer employed by KinderCare sexually assaulted and abused both children while they were minors and under the company’s care and supervision.
The complaint alleges that the perpetrator used his position of authority and trust to isolate the children in areas that were not visible to other staff, including outdoor play areas and secluded spaces within the facilities. The lawsuit further alleges that KinderCare failed to adequately supervise staff, enforce child-safety policies, or intervene despite warning signs that children were being isolated in violation of established rules.
In addition to the alleged abuse, the lawsuit claims that KinderCare failed to comply with California’s mandatory child abuse reporting laws and did not take appropriate steps to investigate or report suspected abuse once it was disclosed. The plaintiffs reported the abuse to law enforcement in 2024, which the complaint alleges is consistent with the delayed disclosure frequently seen in childhood sexual abuse cases.
The lawsuit asserts multiple causes of action against KinderCare Learning Centers, LLC, including negligence, negligent hiring and supervision, violations of the Child Abuse and Neglect Reporting Act, sexual battery, and related civil rights violations. The plaintiffs allege severe and lasting emotional and psychological harm as a result of the abuse and the institutional failures that allowed it to occur.
The allegations underscore the importance of effective supervision, meaningful safeguards, and timely intervention in settings responsible for the care of children.
